Traffic Court Appeals and Article 78 Proceedings

Judges do not always rule in your favor; however, you do have the constitutional right to appeal in writing. Generally it is not necessary for a motorist to return to court. Karen Friedman represent clients in traffic court appeals and appellate proceedings known as Article 78 proceedings.

Traffic Court Appeals

When preparing an appeal to the Appeals Board of the Department of Motor Vehicles or to the New York State Supreme Court, it is necessary to review the record. In most cases, appeals are written on the basis of the transcript or recording of the underlying hearing as well as the exhibits and possibly the written decision of the lower court.

Article 78 Proceedings

Karen Friedman has had success in Article 78 proceedings, challenging lower court decisions. If you feel that you have been wrongfully convicted by an administrative agency, such as the New York Department of Motor Vehicles, she can appeal the decision or appeal the decision of the D.M.V. appeals board by filing an Article 78 case in the Appellate Division or the N.Y.S. Supreme Court.
